Appeal to Set Aside Verdict Will Be Heard on October 26. The last appeal in the Case of Leo M. Frank, the motion to set aside the verdict on the ground that the defendant was not in court at the time it was rendered, will be heard by the Supreme Court of Georgia, October 26. The Case has been pending some time and is almost certain to be heard then. It is generally expected that the high court's decision on the extraordinary motion, which was argued during August, will not be handed down until after the technical motion to set aside has also been heard, and it is possible that decisions on both motions in the Case may be returned at the same time. However, it is also possible that the court may hand down the decision on the extraordinary motion at any time.

Solicitor H. M. Dorsey and the City Detectives, although the former will not make any statement for publication, have been showing an active interest in the Frank Case again since the statement of William M. Smith, former counsel for Jim Conley, that he believes his client guilty of the crime for which Frank has been sentenced to death. Mr. Smith Tuesday refused to make an additional statement, but admitted that he is preparing another card to demonstrate the reason for his change of theory.
