May Be Held Until U. S. Supreme Court Gives Decision

The remittitur in the final appeal in the case of Leo M. Frank was not handed down Tuesday morning by the Supreme Court to the Superior Court, and it is believed that the remittitur will be held by the Higher Court until after the Supreme Court of the United States has announced whether it will sanction a Writ of Error and hear the Constitutional Phase of the Case.

It is said to be likely that the Federal Court will not announce its decision until next Monday, but whether or not the Georgia Court will hold the remittitur for that time is problematical.

Plans are already being made by Frank's attorneys and his friends for a fight for his life before the pardon board and the governor in the event the Supreme Court of the United States refuses to sign the Writ of Error, which would permit a review of the motion to set aside by that court and result in staying the execution of the sentence for more than a year.

To take part in the conduct of the case here, Attorney H. A. Alexander and Leonard J. Haas, who presented the petition to the Supreme Court of the United States, will leave Washington Tuesday afternoon and are expected here Wednesday in the afternoon.

Frank cannot be arraigned in the Supreme Court to have a new date for the execution of his sentence fixed before the remittitur is handed down by the State Supreme Court.
