### Secretary Yancey Declares Special Hearing Rumor Was

Goodloe H. Yancey, Secretary of the State Prison Commission, stated Tuesday that the Frank Appeal for Commutation would, in all probability, take its regular course and come before the Board at the next scheduled meeting, the week of June 7. This Statement followed a Report yesterday to the effect that the Frank Case had been scheduled to come before the Board on May 19. Mr. Yancey said there was no basis for this Report. There has been much Speculation, whether or not the Frank Plea would be heard at a specially called Session, or would take its due course.

Judge Patterson and R.E. Davidson, members of the Prison Commission, will be in Atlanta during the week of May 19, it was stated, although their visit is said to have no connection with the Frank Case. Mr. Rainey may also be here next week. Mr. Yancey said Tuesday that no action had yet been taken or outlined in regard to the Hearing, except, of course, the filing of the Formal Appeal immediately after notification of the Supreme Court verdict.

Even if the Appeal does not come up until June 7, the question of Frank's Fate seems certain to fall into the Hands of Governor Slaton for Decision, who does not go out of Office until June 26, unless the Governor himself puts the Settlement of the Question into the Hands of his Successor.

### Statement by Governor Slaton

An Associated Press dispatch from New York follows: New York, May 11. Governor John M. Slaton, of Georgia, in a Statement made here last night regarding action which he might take in the Appeal of Attorneys for Clemency for Leo M. Frank, said there was a possibility that he might not be called on to act in the Case. He said the Board of Prison Commissioners of Georgia adjourned its Sessions last week to convene again June 7. Governor Slaton's term expires June 26. The Governor stated that it probably would take some time for the Board to Review the evidence in Frank's Case and that its recommendation might not be in hand before the time for his Successor, Judge N.E. Harris, to take Office.
